These terms govern your use of HighMarks (“the service”, “we”, “us”), a Kenyan exam-preparation platform. By signing up or using the service, you agree to these terms. If you don’t, please don’t use it.
1. Who can use the service
- You must be at least 13 years old. If you’re between 13 and 18, you may only use HighMarks with a parent or guardian’s consent.
- You must provide accurate information when signing up — including a real email and an honest qualification track (KCSE or CPA).
- One account per person. Sharing your login with someone else is a breach of these terms and we may suspend the account.
2. What we provide
- Access to practice questions, past papers, mock exams, lessons, and personalised study planning for KCSE and CPA candidates.
- Some content is free; some requires an active subscription. Specifics are shown on /pricing.
- We aim for 99% uptime but do not guarantee it. We may take the service offline for maintenance with reasonable notice when possible.
3. Subscriptions and payments
- Subscriptions are billed in advance via M-Pesa or card through our payment partner, PesaPal.
- Prices are in Kenyan Shillings (KES) and may change with 30 days’ notice to active subscribers.
- Recurring subscriptions auto-renew at the end of each billing cycle unless you cancel from /settings before the renewal date.
- Refunds: we offer a full refund within 7 days of your first paid charge if the service hasn’t met your expectations. Email support@highmarks.io with your transaction reference. Refunds after the 7-day window are at our discretion.
- Failed payments: if your M-Pesa or card payment fails, you have 3 days to update payment details before your access is suspended.
4. Free trial and beta access
- New KCSE students receive a 7-day free trial with full access. No card required at signup; we’ll prompt you to subscribe at the end of the trial.
- CPA students currently receive free beta access. We’ll email you at least 30 days before we transition CPA to paid plans.
- Promotional credits, referral rewards, and similar grants have no cash value and cannot be transferred.
5. Acceptable use
You agree NOT to:
- Share your account, sell access, or use the service on behalf of someone who hasn’t signed up.
- Scrape, copy, or redistribute our questions, marking schemes, lessons, or other content outside of personal study use.
- Try to defeat or interfere with our security, rate limits, or fraud detection.
- Use the service to harm others, harass other users, or send spam.
- Submit false content via the “Improve” button or other feedback channels to game the reward system.
Violating any of the above may result in suspension or termination of your account, at our discretion.
6. Content and intellectual property
- The HighMarks platform, brand, software, and original content (lessons, marking schemes, explanations) are our intellectual property. You receive a personal, non-transferable, non-exclusive licence to use them for your own study.
- Past KCSE and CPA papers are public examination materials of KNEC and KASNEB respectively. We reproduce them under fair use for educational purposes; we do not claim ownership of those underlying papers.
- If you submit feedback, ratings, or content suggestions, you grant us a worldwide, royalty-free licence to use that feedback to improve the product.
7. Accuracy of content
We work hard to keep our content accurate and aligned to the official KNEC and KASNEB syllabuses. But we’re human — mistakes happen. If you spot an error, please flag it via the “Improve” button on any question. We do not guarantee that practising on HighMarks will produce any particular grade or pass result.
8. Termination
- By you: you can delete your account anytime from /settings. If you have an active paid subscription, deletion does not refund unused time unless covered by section 3.
- By us: we may suspend or terminate your account for breach of these terms, fraudulent activity, or extended inactivity (24+ months). We’ll give you notice where reasonable.
- On termination, your access ends immediately. We retain or delete your data per the Privacy Policy.
9. Disclaimer and liability
The service is provided “as is”, without warranties of any kind beyond those required by Kenyan consumer law. To the maximum extent permitted by law, our total liability for any claim related to the service is capped at the amount you paid us in the 12 months preceding the claim.
10. Governing law and disputes
These terms are governed by the laws of Kenya. Any dispute that can’t be resolved by friendly negotiation will be referred first to mediation, and if that fails, to the courts of Nairobi.
11. Changes to these terms
If we change these terms materially, we’ll email every active user at least 7 days before the change takes effect. Continuing to use the service after that date means you accept the updated terms.
